Notes on data processing

1. Name and contact details of the data controller

This data protection notice applies to data processing by the data controller Verein Deutsche Gesellschaft für Abfallwirtschaft e. V. (DGAW), Nieritzweg 23, 14165 Berlin. Two members of the Executive Board are jointly authorized to represent the association.

The members of the Executive Board are

hereinafter referred to as “DGAW”.

2 Collection and storage of personal data as well as type and purpose and their use

2.1 Member administration

We collect the following personal data as part of membership administration:

  • Salutation, title, first name, surname,
  • date of birth,
  • company,
  • address, additional billing address (if different)
  • Telephone number (landline and/or mobile),
  • fax number,
  • valid e-mail address,
  • Your IP address (when contacting us via our contact form on the homepage or via e-mail),
  • Homepage,
  • Date of joining, date of leaving,
  • Type of membership, amount of membership fee,
  • Assignment to membership categories,
  • your bank details (if SEPA direct debit order is issued).

This data is collected

  • to be able to identify you as our member,
  • to carry out pre-contractual measures that are taken at your request,
  • for the fulfillment of mutual obligations arising from the membership relationship
  • for correspondence with you,
  • for invoicing and for financial accounting purposes,
  • to assert and defend against any claims arising from the membership relationship.
     

The data processing is carried out at your request and is necessary for the purposes mentioned for the mutual fulfillment of obligations arising from the membership relationship in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR.

The personal data collected by us in connection with the membership relationship will be stored until the expiry of the statutory retention obligation for business documents subject to retention and then deleted, unless we are obliged to store it for a longer period of time in accordance with Article 6 (1) sentence 1 lit. c GDPR due to tax and commercial law retention and documentation obligations (from HGB, StGB or AO) or you have consented to storage beyond this in accordance with Article 6 (1) sentence 1 lit. a GDPR.
 

2.2 Registration for DGAW events

When you register for one of our events, we collect the following personal data

  • Salutation, title, first name, surname,
  • company,
  • Address, additional billing address (if different)
  • Telephone number (landline and/or mobile),
  • fax number,
  • valid e-mail address,
  • Your IP address (when contacting us via our contact form on the homepage or via e-mail),
  • your bank details (if SEPA direct debit order is issued)
     

This data is collected

  • to be able to identify you as a participant in the event
  • to carry out pre-contractual measures that take place at your request
  • for the fulfillment of mutual obligations arising from the contractual relationship
  • for correspondence with you,
  • for invoicing and for financial accounting purposes,
  • to assert and defend against any claims arising from the contractual relationship.

The data processing is carried out at your request and is necessary for the purposes mentioned for the mutual fulfillment of obligations arising from the contractual relationship in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR.

The personal data collected by us in connection with the contractual relationship will be stored until the expiry of the statutory retention obligation for business documents subject to retention and then deleted, unless we are obliged to store it for a longer period of time in accordance with Article 6 para. 1 sentence 1 lit. c GDPR due to tax and commercial law retention and documentation obligations (from HGB, StGB or AO) or you have consented to further storage in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR.
 

2.3 Subscription to the mailing list for our email newsletter

If you register for the mailing list for our email newsletter, we collect the following personal data

  • Salutation, title, first name, surname,
  • company,
  • address,
  • Telephone number (landline and/or mobile),
  • fax number,
  • valid e-mail address,
  • Your IP address (when contacting us via our contact form on the homepage or via e-mail).
     

This data is collected

  • to be able to identify you as a subscriber to our e-mail newsletter,
  • to send the e-mail newsletter,
  • to assert and defend against any claims arising from the subscription.
     

The data processing is carried out at your request and is necessary for the purposes mentioned for the mutual fulfillment of obligations arising from the subscription to the e-mail newsletter in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR.

The personal data collected by us in connection with the subscription to the e-mail newsletter will be stored until the expiry of the statutory retention obligation for business documents subject to retention and then deleted, unless we are obliged to store it for a longer period of time in accordance with Article 6 para. 1 sentence 1 lit. c GDPR due to tax and commercial law retention and documentation obligations (from HGB, StGB or AO) or you have consented to further storage in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR.
 

2.4 General contact requests

If you send us a general contact request using the contact form on our website, by email, telephone or fax, we collect the following personal data

  • Salutation, title, first name, surname,
  • company,
  • address,
  • telephone number (landline and/or mobile),
  • fax number,
  • valid e-mail address,
  • Your IP address (when contacting us via our contact form on the homepage or via e-mail),
  • the form of contact requested by you (e.g. e-mail, telephone, fax).
     

This data is collected

  • to be able to identify you as the enquirer,
  • for correspondence with you in the form requested by you,

The data processing is carried out in response to your request and is necessary for the purposes mentioned for processing your contact request in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR.

The personal data collected in connection with the processing of your contact request will be stored until the expiry of the statutory retention obligation for business documents subject to retention and then deleted, unless we are obliged to store it for a longer period of time in accordance with Article 6 (1) sentence 1 lit. c GDPR due to tax and commercial law retention and documentation obligations (from HGB, StGB or AO) or you have consented to further storage in accordance with Art. 6 (1) sentence 1 lit. a GDPR.
 

3. Transfer of data to third parties

Your personal data will not be transferred to third parties for purposes other than those listed below.
 

3.1 Transfer of data to the company SEWOBE GmbH, Werner-Haas-Straße 8, 86153 Augsburg, Germany

We have commissioned SEWOBE GmbH, Werner-Haas-Straße 8, 86153 Augsburg, Germany, to provide the online database software “VerbandsManager” in order to process the personal data collected in accordance with sections 2.1. to 2.4. for the purposes stated therein.

SEWOBE may gain access to your personal data in the course of its activities if this data is required to fulfill its respective service. An order processing contract has been concluded with SEWOBE in accordance with Art. 28 GDPR. In this contract, SEWOBE has undertaken to comply with the applicable data protection regulations towards us.
 

3.2 Transfer of data to the company FlexBYTE GmbH, Schönstr. 11, 13086 Berlin, Germany

We have commissioned FlexBYTE GmbH, Schönstr. 11, 13086 Berlin, Germany, to administer and maintain the hardware and software used to process personal data and our website.

FlexBYTE may gain access to your personal data in the course of its activities, provided that this data is required to fulfill its respective service. An order processing contract has been concluded with FlexBYTE in accordance with Art. 28 GDPR. In this contract, FlexBYTE has undertaken to comply with the applicable data protection regulations towards us.
 

3.3 Forwarding of data to the company rapidmail GmbH, Augustinerplatz 2, 79098 Freiburg i.Br.

We have commissioned the company rapidmail GmbH, Augustinerplatz 2, 79098 Freiburg i.Br. with the automated dispatch of our e-mail newsletter.

In the course of its activities, rapidmail GmbH may gain access to your personal data insofar as this data is required to fulfill its respective service.

An order processing contract has been concluded with rapidmail GmbH in accordance with Art. 28 GDPR. rapidmail GmbH has undertaken in this contract to comply with the applicable data protection regulations.
 

3.4 Forwarding of data to the company dogado GmbH, Saarlandstr. 25, 44139 Dortmund, Germany

We have commissioned the company dogado GmbH, Saarlandstr. 25, 44139 Dortmund, Germany with the backup of our company data in an online cloud and with the processing of personal data in accordance with section 2.2. for the purposes stated therein.

In the course of its activities, dogado GmbH may gain access to your personal data if this data is required to fulfill its respective service. An order processing contract has been concluded with dogado GmbH in accordance with Art. 28 GDPR. In this contract, dogado GmbH has undertaken to comply with the applicable data protection regulations towards us.
 

3.5 Transfer of data to the company Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland

We use the registration tool “Google forms” via the company Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. As a result, participant data is stored there.

In the course of its activities, Google may gain access to your personal data if this data is required to fulfill its respective service. No contract has been concluded with google for order processing in accordance with Art. 28 GDPR. You can view Google's privacy policy here.

4. Rights of data subjects

You have the right:

a) in accordance with Art. 7 para. 3 GDPR, to withdraw your consent once given to us at any time. As a result, we may no longer continue the data processing based on this consent in the future;

b) to request information about your personal data processed by us in accordance with Art. 15 GDPR. In particular, you can request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;

c) in accordance with Art. 16 GDPR, to immediately request the correction of incorrect or incomplete personal data stored by us

d) in accordance with Art. 17 GDPR, to request the erasure of your personal data stored by us, unless the processing is necessary for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims

e) in accordance with Art. 18 GDPR, to demand the restriction of the processing of your personal data if the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to delete it and we no longer need the data, but you need it to assert, exercise or defend legal claims or you have lodged an objection to the processing in accordance with Art. 21 GDPR;

f) in accordance with Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request its transmission to another controller; and

g) to lodge a complaint with a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our office.
 

5. Right to object

If your personal data is processed on the basis of legitimate interests in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR, you have the right to object to the processing of your personal data in accordance with Art. 21 GDPR, provided that there are reasons for this arising from your particular situation.
